These terms are a contract between you and Rainmaqer. By creating an account or using the service, you agree to them.
1. Who we are
Rainmaqer ("Rainmaqer", "we", "us") is operated by Shobhit Singh, sole proprietor, trading as Rainmaqer, Lohiyanagar Colony, Varanasi 221007, Uttar Pradesh, India. You can reach us at shobhit@rainmaqer.com or on WhatsApp at +91 98933 56535.
2. Acceptance and eligibility
You must be at least 18 years old and use Rainmaqer for business purposes. If you accept these terms on behalf of a business, you confirm you are authorised to bind that business, and "you" means that business.
3. The service
Rainmaqer provides AI agents and tools that send and receive messages on WhatsApp, Instagram and Google Business Profile on your behalf, along with a deal pipeline, team inbox, broadcasts, chatflows and integrations. The service depends on third-party platforms (such as Meta and Google) that we do not control, and features may change when those platforms change their rules.
4. Accounts and security
- Keep your login details confidential and use two-factor authentication where available.
- You are responsible for activity under your account, including by team members you invite and the roles you give them.
- Tell us promptly at shobhit@rainmaqer.com if you suspect unauthorised access.
5. Subscription and billing
- Plans are billed in advance for the period you choose: quarterly (₹2,999 per month, billed ₹8,997) or yearly (₹1,999 per month, billed ₹23,988).
- GST and other applicable taxes are added to the plan price.
- Plans renew automatically at the end of each period unless you cancel before the renewal date.
- We may change prices with at least 30 days' notice. New prices apply from your next renewal.
6. Wallet and usage charges
- Messaging charges set by Meta (and any similar third-party usage charges) are paid from a prepaid wallet in your account and passed through at actuals.
- Wallet balance does not expire while your account is active.
- Wallet balance is not refundable and cannot be transferred to another account.
- You can set spend caps. If your balance runs out, messages that need wallet credit may stop until you top up.
7. Refunds and cancellation
Cancellation and refunds are covered by our Refund & Cancellation Policy, which forms part of these terms.
8. Meta and Google rules
- You must follow the WhatsApp Business Policy, WhatsApp Commerce Policy and Messaging Guidelines, the Instagram Platform Terms and the Google Business Profile policies, as updated from time to time.
- You must have valid opt-in consent before sending marketing messages, and honour opt-outs.
- You must not send spam or misleading messages, or use the service to gate or manipulate reviews.
- We may pause messaging or suspend an account where needed to protect a phone number, a connected account or the service.
9. AI output
- Replies generated by AI can be incomplete or wrong. You are responsible for your knowledge base, settings and the information you give the agents.
- Customers can always be handed to a human, and you should review conversations regularly.
- Do not use the AI agents to give medical, legal, financial or other regulated advice without review by a qualified person.
10. Acceptable use
You may not use Rainmaqer for content or businesses that Meta's or Google's policies prohibit, for anything unlawful, or to harass, deceive or harm anyone. You may not attempt to break, overload or reverse engineer the service.
11. Your data
You own your data, including your contacts and conversations. We process it on your behalf to provide the service, as described in our Privacy Policy. You are responsible for having a lawful basis to share your customers' data with us.
12. Third-party services and integrations
Integrations with third-party services (such as IndiaMART, Shopify, Razorpay or Zoho) are governed by those services' own terms. We are not responsible for their availability or actions.
13. Availability, support and maintenance
We work to keep Rainmaqer available at all times but do not guarantee uninterrupted service. We may carry out maintenance, ideally with notice. Support is available at shobhit@rainmaqer.com and on WhatsApp.
14. Intellectual property
We own the Rainmaqer software, brand and content. You get a limited, non-transferable right to use the service during your subscription. You keep all rights to your own content and data.
15. Confidentiality
Each of us will keep the other's non-public business information confidential and use it only for the purposes of this agreement.
16. Disclaimers and limitation of liability
The service is provided "as is" to the extent the law allows. We are not liable for indirect or consequential losses, lost profits or lost data. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.
17. Indemnity
You will compensate us for losses arising from your breach of these terms, your messages or content, or your breach of Meta's or Google's policies.
18. Suspension and termination
You can stop using Rainmaqer at any time by cancelling. We may suspend or end your account if you seriously or repeatedly breach these terms or if a platform requires it. On exit, you can ask us to export your data within 30 days, after which we may delete it.
19. Governing law and jurisdiction
These terms are governed by the laws of India. The courts at Varanasi, Uttar Pradesh have exclusive jurisdiction.
20. Changes and contact
